2021-08-10 Court Decision Regarding Fisher River Cree Nation & the Ochekwi-Sipi Personal Care Home Board of Directors

On August 10, 2021, the Court granted the application brought by Fisher River Cree Nation, Chief David Crate and Councillor Darrell Thaddeus against the Ochekwi-Sipi First Nation Personal Care Home Inc., as represented by its Board of Directors, (Manitoba Court of Queen’s Bench file No. CI 20-01-27513).

The application was brought after members of the Board of Directors passed By-Law No. 2/2018, which attempted to strip the Chief of Fisher River Cree Nation and the Personal Care Home Portfolio Councillor of their positions as directors of the Personal Care Home without notice.

The Court found this By-Law invalid, and reinstituted the previous By-Law No. 1/2001, which provides for both the Chief and Portfolio Councillor, along with five elected Board members, including one elder, to act as directors to oversee the operation of the Personal Care Home.

Fisher River Cree Nation is pleased to receive this decision, which will allow the elected Chief and Council to ensure that the community’s elders will receive the best care possible.
